Prohibited Items Policy

1. Policy Overview

Looosh may prohibit listings, images, shop content, messages, or transactions that create legal, safety, trust, authenticity, or community risk. This Prohibited Items Policy describes the categories of items, content, and conduct that are not allowed on Looosh.

This Policy applies to all marketplace activity, including sellers, buyers, listings, listing photos, shop branding, messages, reports, offers, and transactions.

This Policy is incorporated by reference into the Terms of Service and Seller Agreement. Violations may result in listing removal, content rejection, account restriction, or other enforcement action.

2. Seller Responsibility

Sellers are responsible for knowing whether an item is legal to list, sell, ship, and receive in both the seller's jurisdiction and the buyer's jurisdiction. Looosh is not your legal counsel and does not provide legal advice on what you may list.

Sellers must have the legal right to sell each item, including ownership and freedom from liens or other claims.

If an item requires a license, permit, certification, age gate, or regulated handling, the seller must not list it unless Looosh expressly allows it and the seller meets all applicable requirements.

Looosh may remove listings or restrict categories even if similar items appear on other platforms. Platform comparisons are not a defense against policy enforcement.

3. Illegal, Stolen, or Unlawfully Obtained Items

The following are prohibited:

• Illegal goods or services in the seller's or buyer's jurisdiction; • Stolen property of any kind; • Items obtained through fraud, theft, unauthorized access, embezzlement, or misappropriation; • Items that violate court orders, sanctions, embargoes, trade restrictions, or other legal restrictions; • Items whose listing, sale, or shipment would itself constitute a violation of applicable law.

Looosh may report suspected stolen property or other unlawful activity to appropriate authorities where required or appropriate.

4. Counterfeit, Replica, and IP-Infringing Goods

The following are prohibited:

• Counterfeit goods of any kind; • Unauthorized replicas, knock-offs, or copies of branded goods; • Items that infringe trademarks, copyrights, patents, trade dress, or other intellectual property rights; • Items with removed, altered, defaced, or forged brand markings, serial numbers, authenticity holograms, or compliance labels; • Items represented as authentic when they are not.

Sellers may not misrepresent the brand, designer, maker, origin, materials, era, or authenticity of an item. Listings using brand names, logos, or designer references must accurately reflect the item being sold.

Rights holders may report suspected infringement through Looosh's reporting workflows. Looosh may remove infringing listings and may take account action against repeat infringers.

5. Recalled, Unsafe, or Hazardous Consumer Goods

The following are prohibited:

• Products subject to government or manufacturer recall; • Children's products that do not meet applicable safety standards (for example, drop-side cribs, recalled car seats, recalled toys, unsafe sleep products); • Expired infant formula, expired baby food, or other expired infant goods; • Unsafe, expired, or contaminated cosmetics, skincare, or personal-care products; • Electronics or appliances that present fire, electrical, or shock hazards; • Items that present choking, suffocation, poisoning, contamination, or injury risk; • Items missing required safety labels, warnings, or compliance documentation where law requires them.

Sellers are responsible for understanding whether an item they are selling has been recalled or is otherwise unsafe. Reselling recalled goods is generally prohibited even where the seller acquired the item legally.

6. Weapons, Ammunition, Explosives, and Hazardous Materials

The following are prohibited:

• Firearms (including airsoft, BB, and replica firearms where prohibited by law), ammunition, gunpowder, primers, and firearm magazines; • Firearm parts and accessories that are restricted under applicable law; • Explosives, fireworks, flares, and incendiary devices; • Weapons including switchblades, ballistic knives, brass knuckles, throwing stars, or other items restricted in the seller's or buyer's jurisdiction; • Self-defense weapons (such as stun guns or pepper spray) where prohibited by law; • Toxic, flammable, radioactive, corrosive, pressurized, biohazardous, or otherwise hazardous materials; • Chemicals or substances subject to shipping or handling restrictions, including items most carriers will not accept.

Items that are otherwise legal may still be prohibited on Looosh because Looosh does not currently support the compliance controls required to host them safely.

7. Drugs, Controlled Substances, Regulated Medical Items, and Paraphernalia

The following are prohibited:

• Illegal drugs and controlled substances; • Prescription-only medications, including resale of prescription drugs; • Cannabis, cannabis-derived products, CBD, and similar substances where prohibited by law or where Looosh has not expressly enabled the category; • Regulated supplements, nootropics, or performance-enhancing substances where prohibited; • Drug paraphernalia, including items primarily designed or marketed for use with illegal drugs; • Products making unauthorized medical, therapeutic, or health claims; • Expired, recalled, contaminated, or unsafe medical or cosmetic products; • Medical devices, diagnostic devices, or treatment devices that require licensing or regulatory clearance the seller does not hold.

Looosh does not currently support compliance for the resale of prescription, regulated, or medical items. Sellers must not list such items even when they hold relevant licenses unless Looosh has expressly enabled the category.

8. Adult Sexual Content, Nude Images, and Explicit Material

Nude images and explicit sexual imagery are prohibited in listing photos, shop branding, profile content, messages, and any other marketplace content. Sellers must not upload such images even to demonstrate fit, condition, or context.

Adult sexual products or content that violates platform policy, applicable law, or community standards is prohibited.

Sexual content involving minors, exploitation, non-consensual imagery, intimate imagery shared without consent, or content depicting sexual abuse is strictly prohibited. Looosh will report such content and accounts to appropriate authorities, including the National Center for Missing and Exploited Children (NCMEC) or equivalent bodies where applicable.

9. Hate, Extremist, Violent, or Harassing Content

The following are prohibited:

• Items or content displaying hate symbols, slurs, or imagery that promotes hatred against people on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or other protected characteristics; • Extremist propaganda, recruitment materials, or content glorifying designated terrorist organizations, mass violence, or criminal organizations; • Content that threatens, harasses, degrades, or encourages violence against any individual or group; • Items that celebrate or glorify acts of terrorism, mass violence, war crimes, or genocide.

Historical, educational, or museum-context items that depict difficult subject matter may be subject to additional review. Such items are not automatically permitted simply because they have historical context, and Looosh may decline to host them where context cannot be reasonably verified or where listing would create harm.

10. Personal Information, Data, Credentials, and Privacy-Invasive Items

The following are prohibited:

• Personal data, identity documents, Social Security numbers, taxpayer identification numbers, driver's license images, passport scans, or other personally identifying information; • Financial account numbers, payment card numbers, or banking credentials; • Login credentials, account access, or hijacked digital accounts; • Stolen digital goods, including unauthorized software keys, leaked databases, or content obtained through unauthorized access; • Surveillance equipment, spyware, stalkerware, or tools whose primary purpose is unauthorized monitoring; • Hacking tools, malicious software, exploit kits, or services facilitating unauthorized access; • Items or services that invade privacy, enable doxxing, or enable identity theft.

You may not list items containing other people's personal information without their explicit consent, even when the underlying physical item is otherwise allowed.

11. Animals, Wildlife, and Restricted Materials

The following are prohibited:

• Live animals of any kind; • Products made from endangered, threatened, or protected species under CITES, the Endangered Species Act, or equivalent laws; • Ivory, rhinoceros horn, tortoise shell, certain corals, and similar restricted wildlife products; • Prohibited furs, pelts, or animal parts from protected species; • Biological materials, human remains, body parts, or specimens that are illegal, unsafe, or unethical to sell; • Animal-fighting paraphernalia or items that promote animal cruelty.

Vintage or antique items that contain restricted animal materials may still be prohibited even if they predate current restrictions. Sellers are responsible for understanding what they may legally sell and ship.

12. Financial, Government, and Restricted Documents

The following are prohibited:

• Counterfeit currency, including replica or novelty currency that could be confused with legal tender; • Forged documents, fraudulent certificates, or fake credentials; • Government-issued identification, passports, driver's licenses, and birth certificates (whether genuine or fake), where prohibited; • Payment cards, gift cards obtained fraudulently, or unauthorized access to financial accounts; • Lottery tickets, gambling chips, betting slips, or services facilitating gambling where prohibited; • Items that facilitate fraud, identity theft, money laundering, or financial crime.

13. Items Requiring Licensing, Age Restrictions, or Special Handling

Looosh does not currently support compliance controls for many categories of regulated goods. The following are prohibited unless Looosh expressly allows the category and the seller meets all applicable requirements:

• Alcohol, beer, wine, and spirits; • Tobacco, cigarettes, cigars, and tobacco accessories; • Nicotine, vaping products, e-cigarettes, and related supplies; • Regulated food items, raw dairy, raw meat, or food requiring temperature-controlled or specialty handling; • Medical devices, diagnostic equipment, prescription eyewear, hearing aids, or other regulated health products; • Certain electronics requiring FCC, CE, or equivalent certification when sold across borders; • Industrial chemicals, agricultural chemicals, pesticides, and regulated agricultural goods; • Adult products or services restricted by age in the relevant jurisdiction.

Sellers should assume regulated categories are prohibited unless they appear in a Looosh allow-list. Do not interpret silence as permission.

14. Offensive, Graphic, or Inappropriate Content

The following are prohibited:

• Graphic gore, abuse, exploitation, or shock content; • Abusive, threatening, sexually explicit, or discriminatory content in listings, shop pages, photos, or messages; • Content designed to harass, intimidate, or harm other users; • Content that significantly harms marketplace trust, safety, or community standards.

Looosh may remove content for community-standards reasons even if the content is not strictly illegal.

15. Misleading, Fraudulent, or Manipulative Listings

The following are prohibited:

• Keyword stuffing, hidden text, off-topic keywords, or other tactics that distort search; • Bait-and-switch listings (listing one item and selling another, or substituting after sale); • False scarcity, fake countdown timers, or manufactured urgency; • Misrepresentation of condition, defects, age, completeness, materials, brand, designer, maker, country of origin, or authenticity; • False shipping origin, hidden seller location, or misrepresentation of who is fulfilling the order; • Listings designed to evade Looosh's search, moderation, fee, payout, or trust-and-safety systems; • Solicitation of off-platform payment, off-platform contact, or off-platform transactions in order to evade buyer protection and platform fees; • Coordinated inauthentic activity (such as fake reviews, fake favorites, or bot traffic).

Off-platform payment solicitation undermines buyer protection and is treated as a serious violation. Sellers must keep all transactions on Looosh.

16. Services, Intangibles, and Non-Physical Items

Looosh supports physical goods (resale, vintage, handmade) and digital download products listed under Looosh's supported digital download fulfillment type. The following are generally prohibited unless Looosh expressly allows them:

• Services, consultations, or labor-only listings (except as part of a supported handmade or digital product); • Access codes or software keys for external platforms not delivered through Looosh's digital download system; • Subscriptions, memberships, or recurring access products; • Tickets, vouchers, reservations, or experiences; • Cryptocurrency, tokens, NFTs, or other digital financial instruments; • Other intangible items not supported by Looosh's physical or digital fulfillment workflows.

Handmade physical items are supported under the platform's handmade workflow. Digital files and downloads are supported as listings with fulfillment_type 'digital_download' — sellers must use Looosh's digital upload and delivery system, not external hosting links. Pure services and other intangibles remain out of scope unless explicitly enabled.

17. Image and Content Moderation

Looosh may impose limits on image count, file size, dimensions, and file type. Looosh may compress, resize, scan, review, reject, or remove images uploaded to listings, shop pages, or messages.

Nude, explicit, abusive, hateful, or otherwise prohibited imagery may be rejected at upload time or removed after upload. Listings with rejected images may remain unpublished until compliant images are provided.

Looosh uses a combination of automated tools, AI-assisted review, and human review to moderate listings, images, and other content. Automated review does not guarantee that all violations will be detected, and the absence of an immediate flag does not constitute approval.

Repeat image-policy violations may affect a seller's standing and may trigger account-level review.

18. Reporting and Enforcement

Users may report suspected prohibited listings, content, or conduct using the in-app report functionality. Looosh reviews reports and may take action at its discretion, but does not guarantee a specific response timeline or outcome for every report.

Looosh may take a range of enforcement actions in response to violations of this Policy, including:

• Removing or hiding listings, images, or other content; • Cancelling transactions; • Holding, delaying, or reviewing payouts where legally permitted and policy-supported; • Restricting selling features or specific account capabilities; • Suspending or terminating seller or buyer accounts; • Referring matters to law enforcement, regulators, rights holders, or other appropriate authorities where required or appropriate.

Enforcement may rely on automated tools, AI-assisted review, human review, user reports, risk signals, audit logs, and prior account history. Consequential enforcement decisions (such as account suspension) generally involve human review where practicable.

Some violations — for example, severe safety, child safety, or fraud issues — may result in immediate action without prior warning.

19. Appeals and Mistakes

If you believe a listing was removed in error or that an enforcement decision was a mistake, you may contact Looosh support to request review. Please provide the listing or order reference and any context that helps Looosh evaluate the situation.

Looosh may decline to restore listings that pose legal, safety, authenticity, or trust risk, even if the seller believes the removal was a mistake. Review is discretionary and is subject to policy and legal constraints.

Repeat appeal requests on the same matter, or appeals that contain abusive language, may not receive further review.

20. Policy Changes and Contact

Looosh may update this Prohibited Items Policy from time to time as platform features, supported categories, compliance controls, and applicable law evolve. When material changes are made, Looosh will update the date at the top of this page and notify sellers by in-app message or email where appropriate. Sellers are responsible for reviewing this Policy periodically.
